A person commits the offense of trespass in the first degree if he or she knowingly or intentionally enters and refuses to leave the real property of another after having been prohibited from entering or asked to leave the real property by a law enforcement officer if the real property is vacant or a vacant structure. "Vacant real property" and "vacant structure" are defined in the bill.
A law enforcement officer shall not be held liable for acts or omissions made in good faith under this bill.
This bill is similar to HCS HB 1413 (2020).
PROPONENTS: Supporters say that the bill will prohibit squatters from taking advantage of property owners. It should not be difficult to remove trespassers off your property.
