This bill aims to prohibit nonferrous mining in the Rainy River headwaters if sulfate levels in the water increase, thereby protecting the natural resources in that area. It amends Minnesota Statutes 2024, section 84.523, to include new definitions and regulations regarding mining activities. Specifically, it establishes that the commissioner of natural resources cannot issue permits for nonferrous metallic mineral mining unless sulfate levels in affected waters do not increase beyond zero parts per million. Additionally, if sulfate levels do increase, the commissioner is required to suspend mining operations and impose a civil penalty of $500 million for violations.
The bill also introduces a new section, 84.5235, which outlines the process for monitoring and addressing sulfate levels. If an increase is detected, the permittee must suspend operations and can only resume after demonstrating compliance with water quality standards through three years of continuous monitoring by an approved third party. The permittee is responsible for providing access to the mine for monitoring and covering the associated costs. The effective date for these provisions is the day following final enactment.
