This bill mandates human oversight in the creation of official verbatim court records in Minnesota, specifically when artificial intelligence-based tools are utilized. It introduces a new section in Minnesota Statutes, chapter 484, which defines key terms such as "artificial intelligence-based tool," "court," "official verbatim court record," and "qualified court reporter." The bill stipulates that outputs from AI tools cannot solely determine the official court record and must be monitored or reviewed by a qualified court reporter to ensure accuracy and compliance with legal standards. Additionally, the Supreme Court is tasked with establishing policies for this oversight before AI tools can be employed in record creation.
The bill also requires that any official verbatim court record generated with AI assistance must include a certification from the qualified court reporter, detailing the accuracy of the record and the oversight process. Documentation of the oversight must be maintained for a specified period, in line with existing record retention policies. Notably, the bill clarifies that it does not apply to unofficial recordings or transcripts that are clearly labeled as such. The provisions of this bill will take effect on January 1, 2027, and will apply to records created on or after that date.
