This bill mandates access to E-15 gasoline, which is gasoline containing 15 percent ethanol, by requiring retailers to offer it at their fuel stations. Existing retailers must provide E-15 from at least one dispenser by August 1, 2030, while new retailers opening after January 1, 2028, must offer E-15 from at least 50 percent of their dispensers. The bill also establishes provisions for the Department of Agriculture to monitor E-15 supply and prices, issue waivers for small retailers with annual sales under $300,000, and for those with incompatible infrastructure.
Additionally, the bill allows the commissioner to suspend E-15 requirements if economic hardship arises due to price disparities or unavailability. It outlines the process for retailers to apply for waivers, including the need for credible evidence and supporting documentation. The commissioner is tasked with reviewing waiver applications and must publish any waiver orders on the department's website. The provisions of this bill will take effect the day after final enactment.
