This bill modifies the process for terminating a residential lease upon the death or infirmity of a tenant in Minnesota. For leases signed on or after this date, the bill allows a tenant or their authorized representative to terminate the lease upon the tenant's death, requiring written notice to the landlord that is effective no sooner than the last day of the month when the notice is provided. The tenant's estate remains liable for rent and other obligations during the notice period.
Additionally, the bill amends the process for lease termination due to a tenant's infirmity. It specifies that if a tenant requires an accessible unit that the landlord can provide at the same rate within one month of the request, the tenant cannot terminate the lease. The notice period for lease termination due to infirmity is also modified, changing from a requirement of at least two months' notice to a provision that the notice must be effective no sooner than the last day of the month when it is provided. These changes will take effect on August 1, 2026, and apply to leases signed before, on, or after that date.
