This bill establishes regulations regarding the use of artificial intelligence (AI) in psychotherapy services in Minnesota. It introduces a new section, [214.165], which defines key terms related to AI and psychotherapy, including "administrative or supplementary support," "artificial intelligence system," and "therapeutic communication." The bill prohibits the use of AI systems by licensed professionals for making independent therapeutic decisions, directly interacting with clients in therapeutic communication, or generating treatment plans without professional review. However, licensed professionals are permitted to use AI for administrative tasks, provided they maintain full responsibility for all interactions and data.

Additionally, the bill outlines enforcement mechanisms and civil penalties for violations, with fines up to $10,000 per infraction. It mandates that health-related licensing boards investigate any suspected violations and provides a process for individuals or entities to contest penalties. The regulations do not apply to religious counseling, peer support, or self-help materials that do not claim to offer therapy. The provisions of this bill will take effect the day after final enactment.
