This bill proposes new regulations regarding animal testing in Minnesota, specifically prohibiting certain research activities that are reportable to the United States Department of Agriculture under specific federal guidelines. Under the new section [343.41], research facilities in Minnesota are barred from conducting any research, teaching, surgery, experiment, study, or test that falls under the reportable categories outlined in APHIS Form 7023, Column E. However, this prohibition does not extend to activities mandated by federal law or regulations, nor does it apply to federal research facilities.
Additionally, the bill introduces civil penalties for violations of this prohibition. Under section [343.42], any testing or research facility that conducts prohibited activities will face an administrative penalty of $10,000 for each animal involved in the violation. Furthermore, if a violation is deemed willful, the court may require the defendant to reimburse the state for reasonable litigation expenses, taking into account the defendant's economic circumstances.
