This bill amends Minnesota Statutes 2024, section 216B.243, subdivision 8, to update the exemptions to the certificate of need requirement for various energy projects. Notable changes include the addition of new exemptions for the upgrade or rebuilding of existing electric lines with a capacity of less than 100 kilovolts to high-voltage transmission lines with a capacity of 115 kilovolts, provided that at least 80 percent of the upgraded line is located along an existing right-of-way. Additionally, the bill clarifies that the relocation of existing high-voltage right-of-way is exempt as long as new structures are not designed for higher voltage operation.
The bill also retains existing exemptions for cogeneration facilities, high-voltage transmission lines serving single customers, and energy storage systems, among others. The definition of "repowering project" is included to specify modifications that do not increase the nameplate capacity of large wind or solar energy systems. The effective date of the amendments is set for the day following final enactment, applying to projects for which upgrading or rebuilding has begun on or after that date.
