This bill aims to prohibit hotels and health clubs in Minnesota from providing personal care products in plastic containers, wrappers, or other plastic packaging that guests can remove from the premises. The legislation defines key terms such as "personal care product," which includes items like shampoo, lotion, and disposable razors, and outlines that hotels and health clubs may use refillable bulk dispensers or non-plastic packaging. However, hotels can still provide these products upon request from guests.
The bill also establishes enforcement mechanisms and penalties for violations. The Minnesota Pollution Control Agency's commissioner and county boards are authorized to enforce the prohibition, with a first violation resulting in a notice rather than a monetary penalty. Subsequent violations may incur civil penalties of up to $500 per day, with a cap of $10,000 in penalties for a single establishment annually. The law is set to take effect on January 1, 2027, for health clubs and hotels with 50 or more lodging units, and on January 1, 2028, for hotels with fewer than 50 lodging units.
