The bill amends Minnesota Statutes 2024, section 325E.046, subdivision 2a, to modify the certification requirements for entities offering biodegradable or compostable products. It removes the previous stipulation that a distributor or wholesaler may not sell or offer for sale a covered product labeled as "biodegradable" or "compostable" beginning January 1, 2026. Instead, it establishes that such products must be certified by an entity focused on the end-of-life processes for materials designed to fully biodegrade in specific biologically active environments, such as industrial composting.

Additionally, the bill eliminates the requirement that the certifying entity must be a nonprofit corporation and clarifies that the certification must ensure compliance with the relevant subdivisions. The effective date of this section is set for the day following final enactment.
