This bill amends Minnesota Statutes 2024, section 504B.291, subdivision 1, to modify the provisions related to redemption in eviction actions for nonpayment of rent. It establishes that a landlord can initiate an eviction action regardless of whether the lease includes a right of reentry clause and creates a rebuttable presumption that rent has been paid if the tenant provides certain documentation, such as money orders or receipt stubs. The bill also allows tenants to redeem their tenancy by paying the rent in arrears, along with interest, costs, and attorney's fees, and introduces new options for redemption guarantees from third parties with sufficient funds.
Additionally, the bill specifies that if a tenant has paid the rent in arrears but cannot cover the associated costs and fees, the court may allow them to pay these amounts into court to regain possession. It also clarifies that any partial payments accepted by the landlord prior to the issuance of an order for restitution do not waive the landlord's right to recover possession for nonpayment of rent. The effective date of this amendment is the day following final enactment, applying to eviction actions filed on or after that date.
