This bill amends Minnesota Statutes 2024, section 181.9445, subdivision 5, to exempt certain individuals from earned sick and safe time requirements. Specifically, it introduces a new category of exemption for individuals working in positions regulated by the United States Department of Transportation, which includes those for whom the Department has the authority to establish qualifications and maximum hours of service. This addition is marked as
(5) any individual in a position for which the United States Department of Transportation has power to establish qualifications and maximum hours of service under United States Code, title 49, section 31502.
Additionally, the bill modifies the existing definition of "Employee" by removing the previous exclusion for individuals employed by farmers, family farms, or family farm corporations who provide physical labor or management for 28 days or less each year. This deletion is indicated by
or(4) an individual employed by a farmer, family farm, or a family farm corporation to provide physical labor on or management of a farm if the farmer, family farm, or family farm corporation employs the individual to perform work for 28 days or less each year.
