This bill amends Minnesota Statutes 2024, section 241.021, by adding a new subdivision that requires the commissioner of corrections to obtain legislative approval for certain proposed rules before they can be implemented. Specifically, when the commissioner adopts or amends a rule, they must assess whether the cost of compliance for jails, lockups, or workhouses in the first year will exceed $25,000. This assessment must be completed before the close of the hearing record or before submission to the administrative law judge if no hearing occurs. The administrative law judge is then tasked with reviewing and either approving or disapproving the commissioner’s cost determination.
Additionally, if the commissioner finds that the compliance cost exceeds the specified threshold, or if the administrative law judge disapproves the determination that it does not, jails, lockups, or workhouses can file a written statement with the commissioner to claim a temporary exemption from the rules. This exemption remains in effect until the rules receive approval through a law enacted after the commissioner’s determination or the administrative law judge's disapproval.
