This bill amends Minnesota Statutes 2024, section 256B.4911, by adding a new subdivision that establishes a consumer-directed community supports budget exception specifically for individuals diagnosed with both developmental disabilities and type 1 diabetes. The bill mandates that the commissioner create a budget exception process for these individuals within the home and community-based services waivers. To qualify, individuals must have documented diagnoses of both a developmental disability and type 1 diabetes in their assessment.

The budget exception will provide an annualized amount equivalent to nine hours per day of home care nursing at the current rate for registered nurses under the relevant waiver program at the time of application. This new provision is set to take effect on January 1, 2026, or upon federal approval, whichever occurs later, with the commissioner of human services responsible for notifying the revisor of statutes once federal approval is secured.
