The bill amends Minnesota Statutes 2024, section 325E.3892, subdivision 2, to exempt pens that contain lead from the existing prohibition on manufacturing and selling lead-containing products until January 1, 2028. This exemption allows for the continued production and sale of these pens, which would otherwise be restricted due to their lead content exceeding the allowable limit of 0.009 percent by total weight.

Additionally, the bill requires manufacturers of the exempted pens to submit a report every six months to the commissioner of the Pollution Control Agency. This report must detail the barriers to compliance with the prohibition, progress made toward achieving compliance, and the most recent timeline for achieving compliance. The new provisions are effective the day following final enactment.
