The amendment introduces a new provision that allows for this exemption specifically for pens, acknowledging the unique circumstances surrounding their production and use.

Additionally, the bill requires manufacturers of the exempted pens to submit a report every six months to the commissioner of the Pollution Control Agency. This report must detail barriers to compliance with the prohibition, progress made toward achieving compliance, and the most recent timeline for achieving compliance. The effective date of this amendment is the day following its final enactment.
