This bill proposes the implementation of a gross revenues tax on entities that manufacture and sell products containing perfluoroalkyl and polyfluoroalkyl substances (PFAS) in Minnesota. The tax will be set at 50 percent of gross revenue for both manufacturers and retailers with a nexus in the state. Additionally, the bill establishes a new cleanup account within the special revenue fund, which will receive annual transfers equal to the funds raised by the PFAS tax. The revenues collected from this tax, including any penalties and interest, will be deposited into the general fund.

Furthermore, the bill creates the XX Advisory Commission, tasked with developing recommendations for the proper use of funds in the newly established cleanup account. The commission will consist of appointed members from both the House and Senate, as well as the commissioner of the Pollution Control Agency or their designee. The commission is required to meet regularly and submit an annual report to the State Board of Investment detailing its recommendations for fund usage. Initial appointments to the commission must be made by January 15, 2026, with the first meeting convened by July 1, 2026, and the first report due by December 15, 2026.
