This bill amends Minnesota Statutes 2024, section 216B.16, by adding two new subdivisions that modify the procedures for cost recovery related to public utility electric generation and transmission assets. Subdivision 6e requires public utilities proposing to add electric generating facilities or transmission assets to their rate base to provide a detailed assessment of the asset's contribution to system reliability during peak demand, including calculations of seasonal effective load carrying capability. Additionally, it mandates that commission orders must include findings on the asset's reliability contribution, determine recoverable costs, and provide information on approved rates and returns.

Subdivision 6f addresses the reduction in capacity or retirement of electric generating facilities or transmission assets, requiring utilities to demonstrate that such actions will not impair their ability to meet system reliability requirements during peak demand. Commission orders related to these actions must explain their impact on system reliability, considering other scheduled asset reductions. Both subdivisions are effective the day following final enactment and apply to relevant filings made thereafter.
