This bill amends Minnesota Statutes 2024, section 123B.63, subdivision 3, to authorize school districts to reauthorize a capital projects referendum through board action, rather than requiring a public vote. The new provisions allow a school board to renew an expiring capital projects referendum if certain conditions are met, including that the annual amount remains the same as the expiring amount, the term does not exceed the initial term, and the board adopts a written resolution after a public meeting. Additionally, the expiring referendum must not have been previously renewed by board action.

The bill also specifies that the resolution for renewal must be adopted by June 15 of the year the renewed capital levy is first certified and becomes effective 60 days after adoption. It requires that a copy of the resolution be submitted to the commissioner and county auditor by September 1 of the calendar year in which it is adopted. The effective date of this amendment is the day following final enactment.
