The bill amends Minnesota Statutes 2024, section 295.54, subdivision 2, to establish a quarterly pharmacy refund system for legend drugs delivered outside of Minnesota. The amendment changes the refund process from an annual to a quarterly basis, allowing pharmacies to file refund requests based on specific delivery periods throughout the year. Pharmacies can submit their requests for refunds on or after July 1 for drugs delivered between January 1 and June 30, and on or after October 1 for drugs delivered between July 1 and September 30. For drugs delivered in the last quarter of the year, requests can be filed starting January 1 of the following year.

Additionally, the bill specifies that refunds will be calculated based on the tax percentage applicable to wholesale drug distributors under section 295.52, subdivision 3, and clarifies that no refund will be issued more than one year after the end of the quarter in which the drugs were delivered. The effective date for these changes is set for legend drugs delivered outside of Minnesota after December 31, 2025.
