This bill amends Minnesota Statutes 2024, section 123B.63, subdivision 3, to authorize school districts to reauthorize a capital projects referendum through board action, rather than requiring a public vote. The new provisions allow a school board to renew an expiring capital projects referendum if certain conditions are met, including that the annual amount remains the same as the expiring amount, the term does not exceed the initial term, and the board adopts a written resolution after public testimony. Additionally, the renewal must occur no more than two fiscal years before the referendum expires, and the resolution must be submitted to the commissioner and county auditor by September 1 of the year it is adopted.
The bill also includes a provision that the resolution for renewal must be adopted by June 15 of the year the renewed capital levy is first certified, and it becomes effective 60 days after adoption. The existing language regarding the election requirements for capital project levies has been modified to accommodate these new provisions, which streamline the process for school districts to maintain funding for capital projects without the need for a public referendum, provided they adhere to the specified conditions. The effective date of this section is the day following final enactment.
