The "Preserving Outdoor Youth Sports Act" amends Minnesota Statutes 2024, section 116.943, subdivision 5, to allow the presence of perfluoroalkyl and polyfluoroalkyl substances (PFAS) in certain safety-related items and clothing for juveniles operating all-terrain vehicles and dirt bikes. Specifically, the bill introduces exemptions for juvenile products, including all-terrain vehicles and off-highway motorcycles designed for youth, as well as their internal components and safety accessories, provided they do not come into direct contact with the skin or mouth during use. Additionally, sellers of these juvenile products must display a warning label indicating the presence of intentionally added PFAS and its associated health risks.

The bill also maintains existing prohibitions on the sale of various products containing intentionally added PFAS, effective January 1, 2025, while allowing the commissioner to identify additional products that may be restricted in the future. The legislation emphasizes that the use of PFAS in juvenile products is permissible under specific conditions, thereby balancing safety considerations for youth sports with environmental health concerns. The effective date for the provisions of this act is the day following final enactment.
