This bill amends Minnesota Statutes 2024, section 12.31, subdivision 2, to establish new requirements for the declaration and extension of peacetime emergencies by the governor. It mandates that the governor must obtain legislative approval to extend a peacetime emergency beyond 30 days, with the possibility of extending it for an additional 30 days per legislative proposal. The bill also stipulates that the governor must provide at least three days' notice to legislative leaders before convening both houses of the legislature to discuss the extension. Furthermore, it prohibits the governor from allowing a peacetime emergency declaration to expire and then declaring a new emergency for the same situation to circumvent legislative approval.
Additionally, the bill clarifies that if a peacetime emergency is already in effect and the governor needs to declare a separate emergency for a different event, the governor is not required to follow the same declaration process for the new emergency unless seeking federal aid. However, any extensions of either emergency declaration will still require legislative approval. The effective date of these changes will be the day following the final enactment of the bill.
