This bill amends Minnesota Statutes 2024, section 115A.06, subdivision 2, to prohibit the commissioner from adopting rules that apply exclusively to certain types of solid waste disposal facilities. Specifically, the new language states that the commissioner cannot create rules that govern facilities accepting only construction and demolition debris, incidental nonrecyclable packaging, or industrial waste limited to materials such as wood, concrete, porcelain fixtures, shingles, or window glass from the manufacture of construction materials.

Additionally, the bill clarifies that the rules governing the agency's activities must be in accordance with chapter 14, but the restrictions on rule adoption take precedence over any other provisions of law. The effective date of this amendment is set for the day following final enactment and applies to any proposed or adopted rules that are not yet effective as of that date.
