This bill amends Minnesota Statutes 2024, section 204D.19, to establish a set filing period for special elections in the state. It specifies that when a vacancy occurs more than 150 days before the next state general election, the vacancy must be filled at that election, with the filing period for candidates being concurrent with the general election filing period when practicable. If not, the filing period must be between seven to ten days, excluding holidays. Additionally, for vacancies occurring while the legislature is in session, the governor is required to issue a writ for a special election within five days, with a similar filing period of seven to ten days.

The bill also modifies the timeline for special elections, extending the maximum time allowed for holding such elections from 35 to 45 days after a vacancy occurs. It further clarifies that the filing period for vacancies at other times must also adhere to the seven to ten-day requirement. The act is set to take effect the day following its final enactment and will apply to vacancies in legislative offices occurring on or after that date.
