This bill amends Minnesota Statutes 2024, section 148.211, to allow nurses licensed under the Nurse Licensure Compact to practice in Minnesota under specific circumstances during a peacetime emergency or a pandemic/localized disease outbreak. Two new subdivisions are added: Subd. 2b addresses practice during a peacetime emergency, allowing out-of-state nurses with a multistate license to work in Minnesota if they are under contract with a local healthcare provider. It requires verification of the nurse's license and mandates reporting to the commissioner of health regarding the number of out-of-state nurses employed. Subd. 2c similarly allows out-of-state nurses to practice during a pandemic or localized disease outbreak, contingent upon a determination by the commissioner of health regarding staffing impacts.
Both subdivisions stipulate that the out-of-state nurse's license will have the same authority as a Minnesota-issued license while practicing under these provisions. They also require that the out-of-state nurse submits to the jurisdiction of the Minnesota Board of Nursing, which retains the authority to revoke practice authorization. Additionally, both subdivisions will expire if Minnesota joins the Nurse Licensure Compact, with a requirement for the board to notify the revisor of statutes in such an event. The effective date for these provisions is the day following final enactment.
