The "Preserving Outdoor Youth Sports Act" amends Minnesota Statutes 2024, section 116.943, subdivision 5, to allow the presence of perfluoroalkyl and polyfluoroalkyl substances (PFAS) in certain safety-related items and clothing for juveniles operating all-terrain vehicles and dirt bikes. Specifically, the bill introduces exemptions for juvenile products, including all-terrain vehicles and off-highway motorcycles designed for youth, as well as internal components and safety accessories like helmets and boots, provided they do not come into direct contact with the skin or mouth during use.
Additionally, the bill mandates that any juvenile product containing intentionally added PFAS must display a prominent, nonremovable notice warning consumers of the health risks associated with these substances. The act also maintains existing prohibitions on the sale of various products containing PFAS, effective January 1, 2025, while allowing the commissioner to identify additional products that may be restricted in the future. The overall aim of the legislation is to balance the safety of juvenile users with environmental health concerns regarding PFAS.
