This bill amends Minnesota Statutes 2022, section 260E.03, subdivision 15, to redefine the concept of neglect in relation to children's independent activities. The new language specifies that a child whose parent or caregiver allows them to engage in certain independent activities without adult supervision will not be considered abused or neglected solely for that reason. These independent activities must be appropriate for the child's age, maturity, and physical and mental abilities, and the lack of supervision must not be grossly negligent to the point of endangering the child's health or safety. Examples of such activities include traveling to or from school, playing outdoors, and staying home for a reasonable period.
Additionally, the bill removes a previous provision regarding the definition of neglect and introduces a new clause that clarifies the conditions under which a child can engage in independent activities. The intent of this legislation is to provide parents and caregivers with the flexibility to allow children to develop independence while ensuring that their safety and well-being are not compromised.
