This bill allows for state-only funding of personal care assistance services provided by parents, stepparents, or spouses of recipients. It specifically permits these family members to be compensated for their services, despite existing restrictions in Minnesota Statutes. The bill mandates that the commissioner of human services seek federal approval for these payments and allows for state payments to be made without federal financial participation until such approval is obtained. If federal approval is denied, the provision will remain in effect until it expires.
Additionally, the bill includes a provision that it will expire upon the full implementation of community first services and supports as outlined in Minnesota Statutes. The commissioner is required to notify the revisor of statutes when this expiration occurs. The effective date of this legislation is retroactively set to November 11, 2023.
