This bill aims to prohibit the sale and distribution of products containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS) in Minnesota, with specific provisions for various product categories. Effective January 1, 2025, the bill prohibits the sale of carpets, cleaning products, cookware, cosmetics, dental floss, fabric treatments, juvenile products, menstruation products, textile furnishings, ski wax, and upholstered furniture that contain PFAS. Additionally, starting January 1, 2032, any product with intentionally added PFAS will be banned unless deemed a "currently unavoidable use" by the commissioner of the Pollution Control Agency. The bill also mandates manufacturers to disclose information about PFAS in their products, including the purpose and quantity of PFAS, and allows the commissioner to establish fees for compliance.

The bill includes provisions for waivers and extensions regarding information requirements, as well as testing and certification processes to ensure compliance. Manufacturers must notify sellers if their products are prohibited, and the commissioner has the authority to enforce these regulations and coordinate with other state departments. Exemptions are provided for products governed by federal law, certain regulated products, and the resale of used items. The commissioner is also empowered to adopt necessary rules for the implementation of this legislation.
