The proposed bill, known as the "Data Center Energy Standards Act," mandates that by January 1, 2040, data center owners or operators in Michigan must procure clean or renewable energy equivalent to 100% of their annual energy usage. The bill defines key terms such as "clean energy," "renewable energy," and "data center," and outlines the methods by which this energy can be procured, including on-site generation and approved contracts. The Michigan Public Service Commission is tasked with approving these energy procurement methods to ensure compliance with the act.

Violations of the energy procurement requirements will result in civil fines of up to $10,000 per day for each day the violation continues. The enforcement of these fines can be initiated by the county prosecutor or the attorney general, and any collected fines will be deposited into the general fund. Additionally, the commission is authorized to create rules for the implementation of this act under existing administrative procedures. The act will only take effect if a series of related bills from the 103rd Legislature are also enacted into law.
