The bill specifies that the commissioner may take such actions if the investigation reveals certain conditions, including inadequate physical plans, lack of community need, or insufficient experience and financial stability to protect public welfare. Additionally, the bill expands the criteria for disciplinary action against cemetery owners and operators, detailing specific violations such as making false statements, engaging in fraudulent acts, or failing to comply with existing laws.
Furthermore, the bill clarifies that if a permit or registration is denied or revoked, the cemetery operation will cease regarding the sale of burial rights and related services, although the cemetery must still fulfill contractual obligations made prior to the denial or revocation. The commissioner is also granted the authority to impose administrative fines of up to $5,000 for each violation of the act. The enactment of this amendment is contingent upon the passage of Senate Bill No. 1060.
