The proposed bill, known as the "data center regulation act," aims to impose a temporary prohibition on the establishment and operation of data centers in Michigan until April 1, 2027. Specifically, it restricts local units of government from issuing any site plans, permits, or other authorizations for data centers, and similarly prevents the state Department of Environment, Great Lakes, and Energy from granting licenses or permits for such facilities. Additionally, the bill prohibits any person from commencing operations of a data center during this designated timeframe.
Violations of the prohibition on operating a data center will result in civil fines of up to $1,000 per day, enforceable by the county prosecutor or the attorney general. The collected fines will be directed to the general fund. The enactment of this bill is contingent upon the passage of Senate Bill No. 1019 from the 103rd Legislature.
