However, if the act occurs in the presence of a gathering of 10 or more individuals, the penalties increase to a misdemeanor punishable by up to 90 days of imprisonment and a fine of up to $500.

Additionally, the bill defines "public place" to include public streets, sidewalks, parks, and any area that is open to the general public within publicly owned or operated buildings or businesses. The enactment of this amendment will take effect 90 days after it is signed into law.
