A state agency is prohibited from procuring these materials unless they meet this requirement, with the stipulation that materials can still be considered domestically produced if less than 5% of their total cost comes from components not produced in the U.S. The bill also outlines specific conditions under which a state agency may grant waivers to this requirement, including the unavailability of compliant materials, excessive cost increases, or emergencies necessitating immediate procurement.

Additionally, the bill requires state agencies to publish any granted waivers on their websites within 30 days and mandates the Department of Technology, Management, and Budget to provide guidance to procurement officials. It also includes a provision for updating procurement policies to favor projects that utilize products manufactured in Michigan. The act will take effect on January 1, 2030, and will apply to procurement processes unless they conflict with existing laws.
