The bill amends the Michigan penal code by adding a new section, 383b, which establishes penalties for individuals who knowingly and maliciously interfere with the operational technology of critical infrastructure facilities. Under this new provision, such actions are classified as felonies, with penalties including imprisonment for up to 20 years and fines up to $250,000. If the interference disrupts emergency services, hospitals, or water systems, or results in damages exceeding $1,000,000, the penalties increase to a maximum of 30 years in prison and fines up to $300,000.

The bill defines "covered critical infrastructure facilities" to include electric substations, battery energy storage systems, water or wastewater facilities, data centers, and natural gas storage or compression facilities. It also clarifies that the law does not apply to lawful protests, labor activities, authorized research, or law enforcement actions. The new section is set to take effect 90 days after being enacted into law.
