The proposed bill, known as the "data center regulation act," aims to impose a temporary prohibition on the establishment and operation of data centers in Michigan until April 1, 2027. Specifically, it restricts local units of government from issuing any site plans, permits, or other authorizations for data centers during this period. Additionally, the Department of Environment, Great Lakes, and Energy is also barred from granting any licenses or permits related to data centers. Furthermore, individuals or entities are prohibited from commencing operations of a data center until the specified date.
Violations of this prohibition will result in civil penalties, with fines not exceeding $1,000 per day for each day of non-compliance. Enforcement actions can be initiated by the county prosecutor or the attorney general, who may seek to enjoin the violation and collect the fines, which will be directed to the general fund. The act will only take effect if certain related legislation is enacted into law.
