The bill amends the Michigan Zoning Enabling Act by adding a new section, 205c, which establishes specific limitations on minimum setback requirements for dwellings and outbuildings in local units of government that are located within or adjacent to a metropolitan statistical area. According to the new provisions, these local governments cannot impose a minimum setback requirement greater than a specified distance from the front property line or 5 feet from the rear or side property lines.
Additionally, the bill allows for a maximum setback requirement of 25 feet from certain environmental features, including wetlands, inland lakes or streams, and the ordinary high water mark of the Great Lakes or Lake St. Clair. The definition of "metropolitan statistical area" is also included in the new section, referencing the criteria set by the United States Office of Management and Budget.
