This bill aims to prohibit the sale or transfer of certain vapor products that contain a heating element unless that element is made of or encased in glass or ceramic. It defines "person" broadly to include individuals, partnerships, corporations, and other legal entities, and it references the definition of "vapor product" as outlined in the youth tobacco act.
Violations of this prohibition are classified as misdemeanors, with penalties escalating for repeat offenses. A first violation can result in up to 93 days of imprisonment and/or a fine of up to $200, while a second or subsequent violation can lead to up to 180 days of imprisonment and/or a fine of up to $1,000. However, individuals may avoid misdemeanor charges if they can demonstrate that they made reasonable efforts to ensure compliance with the new requirements.
