The bill amends the Elliott-Larsen Civil Rights Act by adding a new section, 706, which establishes guidelines for settlement agreements related to claims of assault, discrimination, harassment, or retaliation based on sex against an employer. It stipulates that such agreements cannot include provisions that prevent or restrict the disclosure of factual information related to the claim. Additionally, the court is prohibited from entering any orders that would conflict with this requirement.
The bill also allows for certain exceptions, such as provisions that shield the identity of the claimant and any information that could lead to their identification, which can be included at the claimant's request, except when a government agency or public official is involved. Furthermore, while the settlement agreement can include a provision that prevents the disclosure of the settlement amount, any provision that violates the disclosure requirements outlined in subsection (1) is deemed void and against public policy.
