This bill amends the Management and Budget Act of 1984 by adding a new section, Sec. 256, which imposes restrictions on the conveyance of state-owned real property. Specifically, it prohibits the state, including the department and the state administrative board, from transferring real property to the United States Immigration and Customs Enforcement (ICE) or any of its subsidiaries.
Additionally, any conveyance of state property must include a restriction that prevents the property from being used as an immigration detention center by the federal government or by any non-governmental entity that contracts with the federal government. The bill also stipulates that if this restriction is violated, the state has the right to reclaim the property. Furthermore, any conveyance that does not comply with these provisions will be considered void and without legal effect.
