This bill amends the Social Welfare Act of 1939 by adding a new section, 109y, which allows eligible individuals to receive medical assistance coverage for donor human milk for their infants. This coverage is available for up to two years following the individual's discharge from the hospital after childbirth or two years after childbirth itself, provided that certain conditions are met.
The conditions for receiving this coverage include having a written prescription from a provider for the donor human milk and meeting one of two criteria: either the birthing person is unable to provide milk, whether temporarily or permanently, or the infant was born before the thirty-fourth week of pregnancy or weighed less than 1,800 grams at birth. The bill is set to take effect on January 1, 2026.
