The proposed bill aims to prohibit the sale of certain dietary supplements for weight loss or muscle building, as well as over-the-counter diet pills, to minors, defined as individuals under 18 years of age. Retailers are required to verify the age of consumers before making a sale, using specific forms of identification, and must implement measures to ensure that minors cannot accept deliveries of these products in virtual sales. The bill also allows retailers to conduct transaction scans to confirm the validity of identification presented during purchases, and it establishes civil penalties for violations of these regulations.
Additionally, the bill mandates the Department of Licensing and Regulatory Affairs, in consultation with the Michigan Board of Pharmacy, to create rules for the implementation of these regulations. Retailers found in violation of the act may face civil fines of up to $1,000, and the Attorney General is authorized to take legal action against them. Importantly, retail clerks are generally protected from disciplinary action for violations unless they are found to be willfully participating in a conspiracy to violate the act.
