This bill amends the Worker's Disability Compensation Act of 1969 to expand the definition of "personal injury" for certain first responders and essential workers. It includes provisions for members of fully paid fire and police departments, as well as essential workers, to receive benefits for respiratory and heart diseases, and illnesses resulting from these conditions, that develop during their active service. The bill also establishes the Christopher R. Slezak first responder presumed coverage fund, which will provide benefits for specific cancers and other health issues related to their work. The fund will be managed by the state treasurer and will require annual reporting on claims and costs.
Additionally, the bill introduces a new section that defines "essential worker" and outlines that personal injury includes injuries or illnesses resulting from exposure to infectious diseases during declared states of emergency. This provision is applicable to injuries occurring on or after March 10, 2020. The amendments also clarify the process for applying for benefits, including the requirement for claimants to first seek pension benefits, and stipulate that claims against employers may be suspended while receiving benefits from the coverage fund.
