This bill amends the Revised Judicature Act of 1961 by adding Section 5707, which allows limited liability companies (LLCs) to be represented in summary proceedings by a member who has direct and personal knowledge of the facts alleged in the complaint. This provision applies specifically to LLCs that either have only one member who is an individual or have two members who are married individuals, provided they have signed a verified statement authorizing the representation and filed it with the court. However, this representation is not permitted if there is an ongoing divorce or separate maintenance action between the members.
Additionally, for LLCs with two members, an individual may only represent the party in a hearing if a designated court employee has reviewed the file and confirmed that the required verified statement has been filed. The bill places the burden of proof on the party seeking to proceed under this section to demonstrate their eligibility. Furthermore, it clarifies that representation under this section does not violate existing legal provisions.
