This bill amends the Public Health Code by modifying section 21311a and adding section 21311b. It establishes criteria for exemptions from licensure as a home for the aged, effective February 11, 2018. The bill stipulates that an existing facility or one under construction can be exempt if certain conditions are met, such as the relationship between the person providing room and board and the person providing supervised personal care. It also introduces a requirement for the owner or operator to submit an attestation to the department, certifying compliance with these conditions, and acknowledges a penalty for false submissions. Additionally, the department is authorized to charge a fee of $2,000 for reviewing these attestations.

Section 21311b allows the department to increase the fee collected under section 21311a at the beginning of each state fiscal year, based on the average percentage wage and salary increase for classified civil service employees. The department is also required to provide a complete schedule of the fees for the upcoming fiscal year to relevant state officials by August 1 each year. This amendment aims to ensure that the fee structure remains aligned with state employee compensation trends while maintaining oversight of facilities exempt from licensure.
