This bill amends the Michigan Code of Criminal Procedure by adding a new section, 21e, to Chapter VIII. It establishes an affirmative defense for individuals charged with felony or misdemeanor offenses, allowing them to argue that their criminal actions were a direct result of being victims of human trafficking, as defined under Chapter LXVIIA of the Michigan Penal Code.

Under this new provision, the burden of proof lies with the defendant, who must demonstrate the validity of this defense by a preponderance of the evidence. The bill is set to take effect 90 days after it is enacted into law.
