The bill amends the existing law regarding civil immunity for operators and users of sport shooting ranges in Michigan. It clarifies that individuals who own, operate, or use a sport shooting range that adheres to generally accepted operational practices are not liable for civil or criminal actions related to noise or noise pollution, provided the range complies with applicable noise control laws at the time of its construction or initial operation. Notably, this immunity extends to ranges that undergo updates or modifications, such as ecological or safety upgrades, as long as these changes also comply with generally accepted practices.
Additionally, the bill allows sport shooting ranges that were in existence on or before July 5, 1994, to continue operating even if they do not conform to new local ordinances. It permits these ranges to repair, remodel, or reinforce their structures for public safety, and to reconstruct or restore nonconforming buildings damaged by various incidents, provided such actions are completed within one year. The bill also emphasizes that these ranges may expand their membership and activities, further supporting their operational continuity despite changes in local regulations.
