This bill amends the Food Law in Michigan by adding Section 7130, which establishes new regulations for baby food sold or offered for sale in the state. It mandates that all baby food must meet specific standards for toxic elements, and starting January 1, 2026, food processors are required to test representative samples of each lot of baby food for these toxic elements at a proficient laboratory. The results of these tests must be made available to the Michigan Department of Agriculture upon request. If any baby food product exceeds the established limits, the manufacturer must either dispose of it or divert it for animal feed, and if the product has already been sold, a recall must be issued.
Additionally, beginning January 1, 2027, food processors must create a webpage for each baby food product that includes test results and a link to relevant health information regarding toxic elements. The webpage must be accessible without requiring proof of purchase, and the product labels must include a QR code linking to this webpage along with a statement about toxic element testing. The bill defines "baby food" and "toxic elements," specifying that the latter includes substances like arsenic, cadmium, lead, and mercury. The bill aims to enhance transparency and safety in baby food products for consumers.
