These conditions include obtaining written, informed consent from the patient or their authorized representative, ensuring that the examination is necessary for preventative, diagnostic, or treatment purposes, or confirming that the examination is part of a surgical procedure or diagnostic examination for which consent has already been given. Additionally, it allows for emergency situations where the patient is unconscious and cannot provide consent.

Furthermore, the bill stipulates that students in health profession training programs are also prohibited from performing invasive bodily examinations on anesthetized or unconscious patients unless the same conditions for consent are satisfied. Importantly, the informed consent must include an option for the patient or their representative to specify whether a student may perform the examination. The enactment of this bill is contingent upon the passage of Senate Bill No. 476 of the 103rd Legislature.
