The bill amends the Public Health Code by adding Section 16280, which establishes regulations regarding invasive bodily examinations performed on anesthetized or unconscious patients. It mandates that licensees or registrants must not perform such examinations unless specific conditions are met. These conditions include obtaining written, informed consent from the patient or their authorized representative, ensuring that the examination is necessary for preventative, diagnostic, or treatment purposes, or confirming that the examination is part of a surgical procedure or diagnostic examination that has already been consented to.

Additionally, the bill stipulates that if a patient is unconscious and unable to provide consent, an invasive examination may still be performed if it is necessary for emergency purposes. Importantly, the informed consent must also allow the patient or their representative to specify whether a student in a health profession training program may conduct the examination. The enactment of this bill is contingent upon the passage of Senate Bill No. 476.
