The bill amends Section 159g of the Michigan Penal Code to update the definition of "racketeering." It specifies that racketeering includes a range of offenses committed for financial gain, such as violations related to tobacco taxes, environmental protection, controlled substances, welfare fraud, Medicaid fraud, gaming, liquor control, securities fraud, and various other criminal activities. Notably, the bill adds new categories of offenses to the definition, including violations related to organized retail crime and fraudulent insurance acts, while also making adjustments to existing categories.
Additionally, the bill removes certain language regarding offenses that constitute racketeering activity under federal law and clarifies the scope of offenses that can be considered racketeering. Specifically, it deletes references to offenses that are substantially similar to those listed in previous subdivisions and replaces them with updated language. The amendments are set to take effect 90 days after the bill is enacted into law.
